So far, our non-profit webpages have already
had over 5,325,000 hits for 2007.
I can't understand how the state or anyone could mock PTSD. A dear
friend of mine was just evaluated at 70% disability by the VA-- but that's after they insisted for years that he only suffered
from 10% disability-- how can a Corpsman only have 10% disability from PTSD? I mean the guy was in Khe Sanh during Tet! I
know that he and a few other guys I know, suffer tremendously. But like you, they're strong and are great living examples
of endurance and determinism. I have seen for myself how PTSD can affect someone's life; it is most certainly
REAL and not one veteran that has to cope with it is crazy-- I know that it is a 100% natural way for one to react to severe
trauma. You, sir, are not messed up or crazy or any other insensitive and ridiculous label that anyone may have tagged on
you and our other Vietnam vets. As for not returning your phone calls-- I wonder how they might like a barrage
of people showing up at their building? They wouldn't be able to ignore you then-- and I know that tons of your brothers would
gladly show up and protest these idiots in support of you. As for that Jon Corzine-- apparently he doesn't understand
who a Marine is, that you never betray your family. If there's anything that I understand about Marines, they do anything
they can to take care of one another and they live up to the standards set by the Corps, for life. I never thought I'd say
this about any Marine, but if this is Corzine's attitude and he uses his service only to get ahead with no regard for others,
he disgusts me and has lost my respect. In my humble opinion, he's lost the right to be called a Marine-- he's betrayed
you and has slapped every vet in the face. I was thinking about how much this can make life so much
more difficult-- I hope that in the midsts of all this, that you are finding ways to try and take good care of yourself? I
know, that's nosy, but I'm concerned. Is there anyone who could possibly take some of the load off your shoulders?
Take on some of the work in trying to deal with this? I know that this must have already come up, but I had to ask. I'm
worried about the toll this has on a guy's health... It'll put someone through the ringer and have horrible affects
on physical health too, aside from exacerbating PTSD... I know, I'm stating the obvious. I admire
your gung ho attitude with this matter, most people would fail to stand up for their rights because it is so much
work trying to get officials to get off their ass and do the right thing. I posted a bulletin
on my myspace page in order to draw some more attention to this case, sent a link so some friends (and strangers) could sign
the petition. With your permission (and it you haven't already approached this option), may I contact someone of influence
with NBC Dateline? I'm not someone of great influence myself, I'm only twenty-two! But I am a writer and have a background
in journalism-- I can get someone's attention. Talk about some great investigative journalism-- I love Dateline NBC...
I believe that they'd want to find out what's going on here. I can't promise anything, but I'd like to try if that's
alright with you. Before my tangent makes me forget! I wanted to let you know that I appreciate sharing your
experience in VN-- I know it's very difficult to share, but there are a lot of us interested in what you have to say! We do
care and take lessons to heart in hearing and reading your experiences. I know that you have been treated very poorly-- and
it couldn't have happened to a more caring group of guys who didn't deserve it in the least. The point is, there are a lot
of us who love and respect our Nam vets-- you're tremendous and I hope that you realize that, despite what some other ignorant
people may do or say. You have my undending support! Thanks Jack, Karen --------------------------------------------------- Karen,
Thank you, very much for your beautiful
letter of support. You are right, I won't give up on the corruption in New Jersey's Office of Attorney Ethics.
Surrender was not an option serving in my Vietnamese peasant-farming village and it is not an option dealing with the State
of New Jersey.
Thanks for your prayers.
I can sure use as much help as possible. Having PTSD has been a tremendous disadvantage in my
charges against the New Jersey Office of Attorney Ethics. A number of times, the State of New Jersey has tried to openly
use my PTSD against me. (Who would believe a PTSD disabled Vietnam Veteran over New Jersey Supreme
Court officials.)
It's been over six years of battling
now and the State of New Jersey still denies me my Due Process. NJ Governor Jon Corzine and his Office of the Attorney
General do not answer my letters and return my phone calls. I guess Governor Jon Corzine thinks I'll just go
away. (The strange, disgraceful thing about Governor Corzine, he served in the United States Marines and uses this fact
every time he runs for elections. He's a true phony politician.)
My Department of Veterans
Affairs (VA) medical records are clear in just how much exacerbation of my PTSD disability, this lawyer and New Jersey State
corruption has caused me, my wife, kids and grandchildren. But I'm not crying.
It just motivates me more in getting equal justice.
A few years ago, I placed my
evidence on the internet in the hope someone in the federal government or State of New Jersey would help me get my Due Process.
These evidence pages get hundreds of readers a day and the count increases everyday. It's only a matter of time before
a true statesman comes forward and follows through on my getting civil rights. (So far, United States Senators
and Members of Congress do not return my letters also.)
In the meantime,
I hoping that the news media and some investigator reporters pick up my fight against New Jersey.
God Bless You and thanks again for your support.
Sussex, NJ
I came across your site and was disgusted as I read what
happened-- I've seen my family have their fair share of run-ins with crooked lawyers... But this is ridiculous.
Of course, I want to help any way I can!!!
I hope that I can provide you with some words of encouragement
as well-- I know that you're determined and not backing down (keep on keepin' on!), but I personally wanted to let you know
that I support you in the fullest.
It's difficult to find words to express how proud I am of you--
words don't even come close. You deserve to have your case noticed, acknowledged. You deserve to see justice-- and
I believe wholeheartedly that you will! You've got a lot of people backing you, here and you will continue to be supported. Darlin',
you've been selfless and caring-- took care of everyone else in Nam without regard for yourself-- a Proud Marine!-- and
it's damn high time that we took care of you. I don't understand how anyone could deny you the respect and fair
shake you're entitled to... But you're doing everything right and your determination is incredible.
Jack, God Bless you. Though "Thank You" is too little,
too late; I am truly thankful for all of our soldiers who took care of each other in Vietnam. I am grateful to you for giving
so much of yourself in countless ways and for helping many of our guys make it back home! In my eyes, you've got to be an
angel-- and I know that there will be a favorable outcome for you in this case. Take Care, Jack and keep
staying strong. I'll send up a prayer for you. Sincerely and respectfully, Karen Scott

There is widespread apprehension
among Veterans about the Veterans Disability Benefits Commission, appointed by the President to study Veterans Benefits.
It is perceived by Veterans, and with very good reason, to be a Republican Plot to reduce and eliminate Veterans Benefits
and there is intense interest in their deliberations among the Military Retirees/Veterans Grassroots Groups on a daily basis.
The Commission announced they would
consider if Disabled Veterans should receive both Social Secutiry Disability Benefits and Veterans Disability Compensation
at the same time. We put so much heat on them they gave up on that idea. Now they are considering if Disabled
Military Retirees should receive both Military Retired Pay and VA Disability Compensation Concurrently (CONCURRENT RECEIPT.)
THIS IS INCREDIBLE BECAUSE CONGRESS JUST PASSED THIS LEGISLATION A COUPLE OF YEARS AGO.
The VDBC is scheduled to make their report
to Congress next fall and I believe there is political capital to be made by taking a position against their efforts to reduce
spending at the expense of Disabled Veterans at a time when so many of our Soldiers have been so grieviously wounded
in Iraq and Afghanistan. I believe this will become a huge campaign issue in the near future.

VETS' COMMISSION SURVEY: WHY ARE THEY
ASKING ALL OF THESE PERSONAL QUESTIONS?
"They also asked me about my volunteer
work."
Many Veterans Administration
Voluntary Services (VAVS) volunteers are disabled Veterans. Some are severely disabled, some not so much. Quite a few volunteers
log 20 to 40 hours each week at their VA facility.
VA volunteers are already acutely aware of those who say that if
a Vet is able to volunteer, he should be able to work. There is always an ongoing quiet discussion amongst volunteers who
are rated as disabled; "What if?"
What if there is an official accounting of disabled volunteers and subsequently a
review of those documented to be logging in for more than, say, 10 hours each week? Currently VA volunteers, like so many
other volunteer organizations, have "bragging rights" that are predicated on how many hours they are signed in as volunteers.
At volunteer services celebrations awards are given and applause is offered to those volunteers who log in the most hours.
The
Vets Commission questionnaire has nothing whatever to do with improving the quality or efficient delivery of health care to
Veterans in desperate need of that care. It has even less to do with improving the current inefficient (and usually wrong)
process of adjudicating a Veteran's claim for disability. In the list of questions your reader sent to you as an example of
what he was asked, over 50% are directly related to the Veteran's ability to work.
This questionnaire is a hard-core
scientific instrument. Those friendly questions concerning his ability to work, perform household chores, participate in hobbies
or interact with family members are aimed toward determining his "Functional Capacity". The determination of Residual Functional
Capacity after a claimed injury or illness is SOP in the disability industry. Each question on this survey will have been
debated and refined by a panel of experts that includes psychologists, physicians, lawyers and social workers. Functional
capacity reporting will provide information to determine an individuals work abilities as well as the status of their disability.
Why
are they conducting this survey? On May 30, 2006 the Government Accountability Office (GAO) issued a report regarding disabled
Veterans harshly criticizing the Veterans Benefits Administration (VBA) for not enforcing stricter requirements for Veterans
receiving 100% IU benefits.
In his excellent article published in June on the military.com web site Tom Philpott reports
that:
"The number of disabled veterans rated IU and the cost of their benefits have risen sharply in recent years.
From fiscal 1996 through 2005, veterans rated unemployable tripled from 71,000 to 220,000. In the same period, IU payments
jumped from $857 million a year to $3.1 billion.
The 'marked increase' is troublesome, GAO suggests, because it has
occurred 'at a time when advances in medicine and technology, along with labor market changes, have provided greater opportunity
for people with disabilities to seek and maintain employment.'
The 54-page report has been much anticipated by members
of the Veterans' Disability Benefits Commission which is conducting the first major review of veterans' disability benefits
in 50 years."
Reading through Tom's article, then the GAO report and later Googling up a few more references leaves
us with a clear understanding of the intent of this survey: This questionnaire is a wolf in sheep's clothing. The Veteran
who responds openly and honestly to this survey is more likely than not going to find that the information he provides will
be used as evidence against him.
Can a Veteran's compensation be reduced? Of course it can.
Reading 38 CFR §3.343,
"Reduction of Service-Connected Total Disability", you'll find that as they are attempting to lower your benefit rating, VA
instructs ratings specialists to; "Cite clear and convincing evidence of actual employability when reducing a rating based
on individual unemployability. Examination reports showing material improvement must be evaluated in conjunction with all
the facts of record. Consideration must be given particularly to whether the veteran attained improvement under the ordinary
conditions of life, i.e., while working or actively seeking work or whether the symptoms have been brought under control by
prolonged rest, or generally, by following a regimen which precludes work."
A Vet's honest answers to the survey may
demonstrate "material improvement" and become "the facts of record". You'll hand over incriminating evidence that your "symptoms
have been brought under control by prolonged rest" and that you've been "following a regimen which precludes work".
During
this intense interrogation if you break and confess that you are a VA volunteer a few hours each week and that you're minimally
able to do some of your own laundry and rake a few leaves or drive a car, you have just provided your accusers with, "clear
and convincing evidence of actual employability" and they will lower your rating to satisfy the bean counters at GAO.
I
opened this rant with some comments about volunteers....now back to that.
I'm a disabled Veteran. I volunteer a few
hours each week at my local VA Primary Care Clinic. I'm proud to be able to give back to my doctor and the other professional
staff who have helped me. I always feel good when I can help a brother or sister in arms. The younger ones are particularly
rewarding...those just returning from the battle really need an experienced hand to guide them.
Most of the volunteers
I work with have disability ratings. Maybe 1/2 are 100% disabled. If this is to be a witch hunt by The Veterans' Disability
Benefits Commission (VDBC) to uncover our dirty little secret...that we're able sometimes to answer a phone or file some papers...we'll
have to give that up. As it stands today it would seem that each time we sign in to our VA facility to do a bit of volunteer
work, we've just raised a red flag and officially documented to VBA on a VA computer system (Searchable by the Commission?)
that we should have our personal disability rating reviewed.
The message from VDBC is pretty straightforward. Don't
try to improve your life by working, volunteering or interacting with those around you. And if you insist on carrying on like
that, for God's sake, don't get caught. A few hours of volunteer work or making your bed each day will be seen as proof that
you enjoy good health and employability. And as long as you're doing so well, your rating will be reduced.

STATE'S SUPREME COURT DISCRIMINATES
AGAINST A DISABLED VETERAN
For seven years, the PTSD veteran is denied Equal
Justice vs. a corrupt law firm.
After one of their attorneys committed gross negligence,
the firm’s partners Joe Truland and James Maynard (Without the client's permission) switched attorney responsibility
of the law case to another Maynard & Truland attorney, Robert Correale, who
happened to be the Vice-Chairman of New Jersey’s Supreme Court Office of Attorney Ethics.
At the time, Attorney Ethics Vice-Chairman Robert Correale
had to feel he was above the law, because he openly over-charged and false-billed his own disabled client.
Correale continued breaking the same
attorney ethics rules...,
that he was punishing other New Jersey
attorneys for.
For seven years now, the Maynard
& Truland law firm has been using their influence in the State of New Jersey
and especially, their influence within the New Jersey Supreme Court's Office of Attorney Ethics.
Former Vice Chairman of Attorney Ethics Robert Correale,
Esq
is now an Assistant District Attorney in Sussex County,
New Jersey.
