Jack Cunningham has been fighting battles since Vietnam. Unfortunately, there are those who think that some of the battles are fair game to discredit him.

I’ve written about Jack’s battle with the law firm of Maynard & Truland, LLC, The NJ State Attorney Ethics Committee and the State of NJ twice now here and here for a run down of the facts and allegations). What is disgusting is that from his attorneys, to the Ethics Committee to higher up in state government feel it’s perfectly fine to label him as some nut and write off or cover up the entire situation. Our veterans, and all others who suffer from Post-traumatic Stress Disorder (“PTSD”), depression or any other mental issue deserve better.

So let’s look at some statistics that might just help us all realize how pervasive the issue of PTSD really is. If you aren’t familiar with PTSD, the Mayo Clinic defines it as follows: “Post-traumatic stress disorder (PTSD) is a mental health condition that’s triggered by a terrifying event – either experiencing it or witnessing it. Symptoms may include flashbacks, nightmares and severe anxiety, as well as uncontrollable thoughts about the event…Post-traumatic stress disorder symptoms may start within three months of a traumatic event, but sometimes symptoms may not appear until years after the event. These symptoms cause significant problems in social or work situations and in relationships.” The symptoms interfere with everything and can be debilitating. However, not everyone has the “Hollywood” PTSD reactions. In fact, Hollywood has probably done more harm to the reputation of Vets and others who suffer from PTSD by portraying them as “nuts” who will be violent and dangerous at the drop of a hat. For Vets like Jack, PTSD is debilitating, but not violence producing. It didn’t stop many from writing him off.

So now some stats:

70% of adults experience some form of trauma during their lifetime. 20% of them will develop PTSD. Today that 20% equals 31.3 million people, and at any given time 8% of Americans suffer from it. 1 out of ten of them are women and women are twice as likely to develop it as men. 3-15% of girls (child or teen) and 1-6% of boys (child or teen) suffer from PTSD. 10-30% of Combat veterans suffer from PTSD, and that figure is fuzzy because many who suffer from PTSD go undiagnosed. The cost in money is staggering. Annual societal costs due to depression, anxiety and PTSD are over $42.5 billion, and those costs inlcude psychiatric and non-psychiatric medical treatment (including prescription drugs), workplace costs and mortality costs. Non-psychiatric costs (doctor and hospital visits) are the biggest component at $23 billion. Much of that cost is due to misdiagnosis. This is because PTSD also presents with other mental illness symptoms like anxiety and depression.

For Vietnam vets, the National Vietnam Veterans’ Readjustment Study found that 30% of men had PTSD at some point since returning from Vietnam. 4 out of 5 reported symptoms 20-25 years later. Much of the lack of treatment was because of mistreatment of Vietnam vets by society. The perception that those who fought in Vietnam were “baby killers” who burned villages for no good reason is still pervasive and keeps many from seeking needed treatment.

Then there is the “oh just get over it” mindset of people who don’t understand PTSD, anxiety and depression. If only it were that easy… Societal stigma against mental illness is staggering. 9% of American adults suffer from depression, and that’s only those who seek treatment. The actual numbers are much higher. Many stay in the darkness of depression because they worry about how other people will treat them.

So, back to Jack, Vietnam veteran. John “Jack” Cunningham is the father of 8, 5 children and 3 step children, and the grandfather of 8. He held a job as project manager and data processor for 20 years. Then PTSD reared its ugly head. It cost him his job and his marriage. The divorce is what precipitated the current battles. Now he just wants to be heard, and have the Courts grant him, and others, reasonable accommodations due to his PTSD.

Actually, let’s hear it directly from him:

“The Maynard & Truland law firm brought to Superior Court a case against Cunningham for an open $2,000 open bill. During the case, powerful and influential, Supreme Court Attorney Ethics official Robert Correale represented himself and his own law firm, Maynard & Truland. I represented myself, since no New Jersey lawyer wanted to take the case without big money up front. My legal malpractice complaints started with Robert Correale’s and his law firm’s gross negligence, over-charging per hour, false billing, lack of communications, coming to court unprepared and perjury. My evidence was extensive, yet simple. Evidence was Maynard & Truland’s own contact, their own invoices, court-filed letters, court-filed documents, federal Veterans Affairs medical records, etc.

Nothing was resolved during arbitration. But back in the courtroom, Honorable Superior Court Judge Ronald Graves announced that he had reviewed my detailed evidence. He threw out Robert Correale’s law firm open bill case and then, against the objection of Correale, stated that my charges of legal malpractice warranted the Superior Court Law Division for damages. Months later, when I brought the case to the Law Division, Judges Graves court transcript could not be used as merit, because the court clerk’s only copy of the audio transcript was mysteriously missing and could not be transcribed.”

Jack just wants his day. Here’s hoping he finally gets it.

Federal Criminal charges are the first thing this disabled veteran wants against all those involved in the State of New Jersey Supreme Court Ofice of Attorney Ethics Cover-Up.
The New Jersey Supreme Court is violating our Constitution, when they protect the elite, powerful and politically connected attorneys from our laws, while all the rest of the state's attorneys get thrown into the basket.

Very few of New Jersey attorneys have the balls to go after this system, but the vet hopes there are some...
New Jersey Supreme Court Office of Attorney Ethics official Robert Correale himself was involved in charges of Legal Malpractices in NJ Superior Court and Attorney Ethics Violations in NJ Supreme Court. Both of these cases quietly disappearing can be thanked to the long arm of power of the NJ Supreme Court.
Even after almost fifteen (15) years, one dedicated military veteran has not given up the fight to bring Robert Correale and those, who protected him and his law firm, to Justice. You can read some details at:

It Is Well-Worth The 'FIGHT' To Bring Justice

I’m hoping I can be guided into the rules for filing a federal case against New Jersey Supreme Court and Superior Court in Federal District Court.  The case centers around the New Jersey courts attempt to deceive, an act of fraud, an act to manipulate due process, along with a few other allegations.  

The fact that I’ve been handling this so far as PRO SE is somewhat of a accomplishment.  I have brought it through New Jersey Superior Court Special Civil Part, the Law Division and the Appellate Division.   But the added fact that I’m considered by the federal Department of Veterans Affairs (VA) to be 100% ‘Permanent and Totally’ disabled with Post Traumatic Stress Disorder (PTSD) from heavy combat during my serving in a Vietnamese peasant-farming village, just adds to my limitations and exacerbation of my disability. 

PRO SE is tough enough, but with PTSD, it’s traumatic.  I was almost hospitalized over this a few times.  Besides the New Jersey courts, I’ve been tagged-teamed by five lawyers from a corrupt former, Morristown law firm, Maynard & Truland, who are at the center of a legal malpractice case and attorney ethics violations.  I’m not crying over it though;  I just want my Due Process.

I have been at this for about 15 years trying to get the State of New Jersey to do the right thing for Justice, but they throw too many roadblocks, especially the one of denying to read my correspondence.  They even lost a Superior Court transcript of a court case, where the judge, after reviewing some of my detailed and clear evidence, sided with me.  The New Jersey Supreme Court even accepted numerous perjury-filled sworn certifications without even one piece of supporting evidence.  

Being a PTSD vet, I strongly feel they want me to drop this case, but I can’t.  My Department of Veterans Affairs (VA) therapists recommend I just drop this case and move on with life.  They understand how it brings up traumatic issues from my war experiences.  I've been at this for near 15 years and I have not given up.   I never want this to happen to another PTSD vet again. 

Once all the details about this court battle come out, I’m hoping that some actual federal criminal charges be brought against some key New Jersey State Government officials.  And I’m also hoping that the federal government will protect PTSD veterans in future, corrupt court actions and DISCRIMINATION issues.  During the different levels of NJ Superior Court and NJ Supreme Court actions, I just about begged for some ‘Reasonable Disability Court Accommodations.’

The reason why I’ve been PRO SE handling this over-decade battle to get justice is because no sane New Jersey attorney would take on this case without huge payments.  I’m been going after the New Jersey Courts systems and especially, the NJ Supreme Court Office of Attorney Ethics.  Win or lose, an New Jersey honest, professional attorney could destroy his or her career.  Since I live off of VA disability benefits and Social Security disability payments my financial resources are limited. 

If United States District Court can assign me a PRO BONO attorney, I’d more than greatly appreciate it. (Less Stress)

Any direction you can help me in bringing a federal case against a corrupt law firm, and NJ courts who tried to protect them, I’d greatly appreciate.  The initial cause of 15 years of battle is an attorney, Robert Correale from the corrupt firm, who was also on the local, NJ Supreme Court Office of Attorney Ethics committee.  (One piece of evidence has ROBERT CORREALE listed as the vice-chairman of his attorney ethics committee)  

Robert Correale was able to protect his former law firm, Maynard & Truland and himself.  And then the NJ Supreme and NJ Superior courts did the protecting him.  It would be a tremendous embarrassment to the State of New Jersey if one of their Supreme Court Office of Attorney Ethics officials was found guilty of legal malpractice in civil court and attorney ethics violations in NJ Supreme Court.  How this corrupt Supreme Court official, his corrupt law firm were so easy allowed to use their state wide influence should be also investigated so it never happens again.

If it was not for the on-going and daily growing support that I receive from my family, friends and tens-of-thousands of social-media supporters, these corrupt government officials would be another gang that just got away.

 Jack Cunningham's case is interesting, I have run into certain things in NJ courts myself…

Statute of limitations issue is bogus… fraud has no limitation in federal court, and Statute of limitations runs from the time the fraud is found… It is an act to deceive, an act of fraud, an act to manipulate due process, - sanctions should be implemented – One of many cases spell this out… Referring both to the objective and subjective elements, we have held that qualified immunity would be defeated if an official "knew or reasonably should have known that the action he took within his sphere of official responsibility would violate the constitutional rights of the [plaintiff], or if he took the action with the malicious intention to cause a deprivation of constitutional rights or other injury." Harlow et al v. Fitzgerald, 457 U.S. 800; 102 S. Ct. 2727; 73 L. Ed. 2d 396; (1982). (Emphasis added)

File a civil suit in the United States District Court for the District of New Jersey (federal court) - file this Civil Complaint under U.S.C. 28 §1331, federal question, civil actions arising under the Constitution, under U.S.C. 42 §1983, a civil action for deprivation of rights, and U.S.C. 42 §1985 a civil action for Conspiracy to interfere with civil rights against all Defendant’s you can list (growing list below)… you can do it pro se and file an application to proceed indigent… all documents are on the District of New Jersey (federal court)’s web site…  

State courts have concurring jurisdiction over this type of civil suit, it can be filed in state court BUT Federal Courts are more easygoing with Pro Se writings, minor errors in format and rules etc… And if a state attorney represented anyone, the challenge here would be if he was authorized to do so… i.e. an application filed for their service, defendant within the scope of employment… etc… if not.. it was fraud…

Void Judgments, move to vacate previous judgments for harmful errors, constitutional violations, fraud… etc… all forms and docs you need are on the court web sites.
